A First-Hand Look at China’s Draft Foreign Investment Law - M2M Series

The Ministry of Commerce recently released the draft Foreign Investment Law. Once the law is adopted, China’s current foreign investment regime, started in 1979, will be fundamentally changed. The new system will be based on the negative list approach, national security review system and periodical reporting obligations.

Simmons & Simmons Partner Alan Xu has been invited by the Chinese government to participate in the legislation of China’s national security review system since 2010 (now Chapter 4 of the law). He also helped to coordinate the EU Commission and its chambers in preparing comments to the law. As such, his first-hand knowledge of the discussions around the drafting of the law are of great value to business and legal professionals.

Xu's presentation will cover the following subjects:
- Overview of the proposed new law, including its drafting process, key aspects and implications to international investors
- Policy trends reflected in the new law
- Challenges and opportunities presented by the new law to international investors
- Next steps

About the speaker:
Alan Xu is a partner in the corporate and commercial group of Simmons & Simmons. He has extensive experience in advising multinationals expanding into China, including foreign direct investment and mergers and acquisitions. He also frequently advises Chinese state-owned and privately-owned companies on their overseas acquisitions. Xu is qualified to practice law in both China and New York.
